FACTS. - Dickert & Eddy assigned certain coal leases to Heiner & Hunter with covenants to produce coal and pay a royalty. Heiner & Hunter later assigned the leases to Groves. Groves assumed the covenants of Heiner & Hunter to Dickert & Eddy, and Groves also agreed to pay Heiner & Hunter a royalty. By agreement with Dickert & Eddy, Groves ceased production but continued to pay Dickert & Eddy a monthly "royalty." Groves stopped paying royalties to Heiner & Hunter.
